Impact of Brexit on the Lift Industry and Lift Owners/Employer
The Lift Industry in the Republic of Ireland has for decades been dependable on Notified Bodies that are based in the UK. All current Irish Lift Installers are certified by a UK based Notified Body.
Notified Bodies are the control mechanisms of the European Union to ensure that equipment in general but for lifts in particular meet the Essential Health & Safety requirements of the relevant European Directive.
Lift Installers need to be under the surveillance of a Notified Body to install and to repair or upgrade lifts.
If Lift Installers are not under the surveillance of a Notified Body, they cannot place lifts into service on completion of the installation, major upgrade or repair.
The expectation is that the UK will leave the European Union in some form or shape. But whichever form that will take, the Notified Bodies in the UK will lose their status and will not be able to serve the Irish Lift Industry after the UK has left the EU.
At this moment in time, there is no Notified Body for Lifts based in Ireland.
Irish based Lift Installers need to employ Notified Bodies other than UK based Notified Bodies when the UK leaves the EU.
In principal, Lift Installers can employ any Lift Directive(s) accredited Notified Body in the European Union.
If the Irish Lift Installer has not changed Notified Body and the UK crashes out of the EU, then the Lift Installer is no longer certified to issue Declarations of Conformity, CE marking on the lift and to place lifts into service on the Irish Market.
This can mean for employers/owners that they cannot utilise the lifts in their building.
Besides the risk of lifts not been able to be put into service, there could be financial implications if or when European based Notified Bodies need to come to Ireland to certify lifts, if or when the Lift Installer has not been able to achieve the Notified Body certification in the event of a no deal Brexit.
We recommend engaging with your Lift Installer and ask what contingency plan they have in place when the UK leaves the EU in relation to placing lifts into service on the Irish Market.

Every Lift requires a Thorough Examination before first Use in accordance with Safety, Health & Welfare at Work (General Application) Regulations 2007, as amended by a Competent Person that can exercise an independent and impartial judgement.
